Terms & Conditions

This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement. This agreement shall be governed in accordance with the laws of England and Wales.

A non‐refundable booking fee of 30% as well as signing the contract secures the time and services of the Photographer for the Event. If the Event is rescheduled, postponed, or cancelled; or if there is a breach of contract by the Client, booking fee is non-refundable and shall be used to cover the expenses and loss to the Photographer. The deposit will be deducted from the cost of the client’s chosen package when calculating the final balance due. Weddings that are postponed to a later date will retain the fee as long as the photographer can re‐schedule for the new date and time.

The client agrees to confirm the schedule at least one-week prior to the Event. Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the Photographer by the Client.

The Photographer reserves the right to terminate coverage and leave the location of the Event in case of inappropriate, threatening, hostile or offensive behavior from person(s) at the Event; or in the event that the safety of the Photographer is in question.

The Client and the Photographer agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. All additional time beyond the schedule will be billed to the Client.

For attendance at venues at a distance over 35 miles radius, travel costs at the rate of £0.5 per mile will be charged where appropriate. Where the wedding and ceremony require an overnight or longer stay, whether in the UK or abroad, then modest hotel and subsistence charges will be made.

The Photographer is not responsible for compromised coverage due to causes beyond the control of the Photographer including but not limited to obtrusive guests, lateness of the Client or guests, weather conditions, schedule complications, incorrect addresses provided to the Photographer, rendering of decorations, or restrictions of the locations. The Photographer is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The Photographer is not held liable for missed coverage of any part of the Event and will not be held accountable for failure to deliver images of any individuals or any objects at the Event.

The Photographer is limited by the rules and guidelines of the location(s) and site management. The Client agrees to accept the technical results of their imposition on the Photographer. Negotiation with the officials for moderation of guidelines is the Client’s responsibility; the Photographer will offer technical recommendations only.

The Client is responsible for acquiring all permits and necessary permission for all locations on which the Photographer will be performing services.

The photographs produced by the Photographer are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the Photographer explicitly written permission. Limited copyright ownership of the resulting images will be transferred to the Client with images on USB, where the Photographer grants the Client permission to print the images, share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered. The Client must receive written permission from the Photographer prior to publishing or selling the photographs.

In the unlikely event that the assigned photographer is unable to perform to the guidelines of this contract due to an injury, illness, or other cause beyond the control of the Photographer, the Photographer will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the Event.

In the unlikely event of a photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client is left to the discretion of the Photographer.

The final post production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer. All images will be adjusted for exposure, brightness, contrast, sharpness, etc. The Photographer’s judgement regarding these corrections shall be deemed correct. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost.

The aforementioned 30% non-refundable booking fee is due at the time of signing of agreement. The remaining balance is payable in full prior to, or on the day of the Event.
If the Client fails to remit payment as specified, the Photographer shall have the right to immediately terminate this agreement with no further obligation and retain any money already paid..

Services or products not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may only be applied toward products purchased from the Photographer.

The photographer collects a variety of information directly from the Client, before, during and after the Event. It includes names, contact information, sometimes gender and age and is used solely for the purpose of providing the service. The photographer collects, stores and processes Client’s data in such way that should have no negative effect on the Client as an individual. The photographer does not sell Client’s data to any third party organisations. The data collected, including photos taken during the event, is being stored and managed in a safe way, locked or password protected.
